Land Acquisition Act, 1894-S-28-A (as inserted by Act 68 of 1984) – Held prospective in nature and does not apply to an award made by Civil Court prior to 24 Sept 1984. Section 28-A, 23(1-A) and 2 and 28 –e determination of compensation by Collector not challenged by State –High Court at the instance of Claimant granted additional statutory benefits. Appealed by State against grant of additional statutory benefits. Award of Collector found to be without jurisdiction and nullity –Held –High Court equally had no jurisdiction to award statutory benefits. Award of statutory benefits not independent of the award or in its substitution –Hence entire award vitiated by manifest error of law warranting interference by the Supreme Court-Constitution of India, Art 136.
